Agreement

These terms govern your use of riversedgedurango.com and, where stated, the services you book with River’s Edge Wellness Center, operated by River’s Edge Durango LLC of 1521 Main Avenue, Durango, Colorado 81301 (“River’s Edge”, “we”, “us”).

Medical and medical-aesthetic services are provided under the supervision of our Medical Director, Ashley Sutton.

By using this website or booking with us, you accept these terms. If you do not accept them, please do not use the site.

02

Who may use this site and book services

You must be at least 18 to book any service through this website.

We welcome younger guests for designated spa and salon services — hair, nails, and massage — provided a parent or legal guardian is present at the appointment and signs the consent and health history forms. We do not provide injectable, laser, hormone, weight-loss or other medical or medical-aesthetic services to anyone under 18.

Some treatments have their own age, health or eligibility requirements, and we may decline or stop a service where it is not appropriate for you.

03

Information on this site is not medical advice

The descriptions of treatments, conditions and outcomes on this website are general information. They are not medical advice, not a diagnosis, and not a treatment recommendation for you.

Nothing here creates a provider–patient relationship. That begins at a consultation.

Individual results vary. Photographs, testimonials and described outcomes are examples, not promises of what will happen for you. Always speak with a qualified professional before starting any treatment, and never disregard or delay medical advice because of something you read here. If you have a medical emergency, call 911.

04

Booking and payment

Appointments are booked through our booking provider, Boulevard, and are subject to availability. A booking is confirmed when you receive confirmation from us, not when you submit a request.

We ask for a payment card to reserve your appointment. It is not charged when you book. It is held only so that the cancellation terms below can be applied, and you pay for your service at the appointment.

We are a cash-pay practice. We do not bill insurance, and we cannot guarantee that any service is reimbursable by your insurer, HSA or FSA. Any claim you make is between you and them. We can provide an itemised receipt on request.

05

Cancellations, changes and missed appointments

We ask for 24 hours’ notice to change or cancel an appointment.

Cancelling with less than 24 hours’ notice, or not arriving, may result in a charge of 50% of the booked service price to the card held on file.

If you arrive late we will do what we can, but your treatment may be shortened so the next guest is not delayed, and the full price will still apply.

We understand that illness and emergencies happen, and we will use common sense. Repeated missed appointments may mean we ask for prepayment in future.

We will occasionally need to reschedule you — illness, equipment, weather. We will give you as much notice as we can and will never charge you for a change we make.

06

Pricing, packages and series

Prices on this website are current at the time of publication and may change. The price that applies is the one quoted at the time of booking or in your consultation. We correct pricing errors when we find them and will always tell you before charging you a corrected amount.

Packages and treatment series are non-transferable and expire 12 months from the date of purchase. Unused sessions after that date are forfeited. We will tell you before that happens.

07

Gift cards

Gift cards are sold and redeemed through Boulevard and may be used for services and retail at River’s Edge.

If the balance remaining on a gift card is $5.00 or less, you may ask us to redeem it for cash, and we will.
Otherwise gift cards are not redeemable for cash.
We cannot replace a lost or stolen gift card without a record of purchase.
The $5.00 cash-redemption right is Colorado law — C.R.S. § 6-1-722.
08

Memberships

Memberships are governed by our Membership Terms, which form part of these terms. In summary: a six-month minimum commitment then month-to-month, 30 days’ notice to cancel, monthly treatments roll over for up to three months while active, and account credit remains redeemable for 90 days after cancellation.

Where these terms and the Membership Terms conflict, the Membership Terms govern for membership matters.

09

Retail products

We do not currently sell products online. Prices shown in our shop pages are for reference and purchases are made in person in Durango.

Unopened retail products may be returned within 14 days with proof of purchase, for exchange or refund to the original payment method. For health and hygiene reasons we cannot accept returns of opened skincare, cosmetics, supplements or personal-care items unless the product is faulty. This does not affect your rights in respect of faulty goods.

10

Services are not guaranteed

We will provide our services with reasonable care and skill by appropriately trained staff. We do not guarantee any particular result, because outcomes depend on your physiology, history and aftercare.

Where a specific written guarantee is offered for a named programme, its own terms apply.

11

Your responsibilities

You agree to give us accurate and complete health information before treatment, to tell us about changes to your health or medication, to follow the aftercare you are given, and to treat our staff and other guests with respect. We may refuse or discontinue service to anyone behaving abusively or unsafely.

Incomplete or inaccurate health information can make a treatment unsafe. Please do not leave things out.

12

Our content

Everything on this website — text, photographs, logos, design — belongs to River’s Edge or is used with permission, and may not be copied or reused commercially without our written consent. You may share links and print pages for your own personal use.

13

Links to other sites

We link to other services, including our booking provider and payment-plan provider. We are not responsible for their content or their practices, and a link is not an endorsement.

14

Limitation of liability

To the fullest extent permitted by law, River’s Edge is not liable for indirect, incidental, special or consequential losses arising from your use of this website or from services booked through it, and our total liability for any claim is limited to the amount you paid for the service giving rise to the claim.

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for professional negligence, or for anything else that cannot lawfully be limited or excluded.
15

Indemnity

You agree to indemnify River’s Edge against claims arising from your misuse of this website or your breach of these terms.

16

Governing law and where disputes are heard

These terms are governed by the laws of the State of Colorado. Any dispute arising out of them or out of your use of this website will be brought in the state or federal courts located in La Plata County, Colorado, and you agree to that venue.

These terms do not contain an arbitration clause. Any question of medical malpractice or professional negligence is decided by a court unless you have separately signed a written arbitration agreement meeting the requirements of Colorado law.

Colorado requires strict compliance with C.R.S. § 13-64-403 for malpractice arbitration agreements, including prescribed wording, a signature-adjacent notice and a 90-day right to rescind — none of which a website terms page can satisfy.
17

Changes to these terms

We may update these terms. The version in force is the one published here on the date you use the site or book a service.
